Terms of Service
Rental Coverage and Site Responsibilities
Kentucky Porta Potty Pros provides portable restroom rental, delivery, placement, servicing, pickup, and related sanitation work described in an approved quote. The quote may identify the unit type, rental period, service visits, delivery area, and access needs.
Customers must provide a safe, clear location with suitable ground access. Placement must follow the Kentucky Plumbing Code requirements for portable restroom sanitation, local zoning permits, and any direction from the Shelby County Fiscal Court. Event placement may require confirmation with local officials and the Kentucky Department for Environmental Protection.
Accessible units and placement must support the 2010 ADA Standards, including accessible routes and restroom clearances. Construction sites must provide sanitation facilities consistent with OSHA 29 CFR 1926.51, administered by the United States Department of Labor Occupational Safety and Health Administration.
Excavation, permanent plumbing, utility work, permit fees, damage repair, unusual cleaning, and unauthorized sewage discharge response require a separate agreement. The EPA Clean Water Act and Kentucky wastewater disposal rules apply to all waste handling.
Appointments, Changes, and Cancellation Notice
Appointments are scheduled after Kentucky Porta Potty Pros receives the requested location, dates, unit details, access information, and customer contact details. A booking is confirmed when the company accepts the request and provides written confirmation, a quote, or another clear approval.
Customers should give notice as soon as possible for cancellations, date changes, delivery changes, or pickup changes. A short-notice request may be limited by truck routes, inventory, staffing, or site access. Any cancellation charge or retained payment will follow the approved quote or written service agreement.
A scope change means a request that changes the number of units, unit type, rental period, service frequency, placement, delivery conditions, or pickup timing. Scope changes require company approval before work proceeds. Added work may change the quoted amount.
Bad weather, blocked entrances, unsafe ground, event restrictions, or missing site access may require a new appointment. Kentucky Porta Potty Pros will communicate the revised plan when practical and will document material schedule changes in writing.
Quotes, Approval, and Payment Terms
A quote from Kentucky Porta Potty Pros is based on the information available at the time, including unit selection, rental dates, delivery distance, access, service frequency, placement conditions, and pickup needs. It is not a promise to perform work outside the items described in the quote.
The customer approves the quote by signing it, accepting it in writing, paying an amount requested for booking, or authorizing work through another recorded method. Payment timing, deposits, taxes, service charges, and accepted payment methods will appear in the quote or service agreement. No specific price or payment plan is created by this page.
Requests added after approval must be reviewed before completion. Examples include extra units, added pumping, longer rental use, a second delivery attempt, difficult access, or damage cleanup. Kentucky Porta Potty Pros may issue a revised quote or written change approval.
Invoices are due according to their stated terms. Disputed charges should be reported with the invoice details and a short explanation. Unpaid balances may affect future scheduling and may be referred for lawful collection.
Service Quality and Written Warranty Terms
Kentucky Porta Potty Pros stands behind the work it agrees to perform: delivery to the approved site, placement consistent with the confirmed instructions, scheduled servicing, and pickup under the accepted rental terms. The unit must remain reasonably accessible, and the customer must report a service concern with the location and rental details.
Any workmanship warranty, correction period, or service guarantee will be stated in the applicable quote or written service agreement. This page does not create a fixed warranty duration. If no separate warranty is written, the company will review a reported problem and determine a reasonable service response under the booking terms.
Coverage does not extend to misuse, vandalism, relocation without approval, excess waste, foreign objects, unsafe access, weather damage, poor site conditions, third-party work, or failure to follow care instructions. Damage or added cleaning may be charged when allowed by the agreement.
Nothing here removes rights that cannot be waived under Kentucky law. Customers should report concerns promptly so the company can inspect the unit and record the condition.
Responsibility for Site Conditions and Service Risk
To the fullest extent allowed by Kentucky law, Kentucky Porta Potty Pros’ responsibility for a claim tied to a rental or service is limited to the amount paid for the specific service that caused the claim. The company is not responsible for indirect loss, lost revenue, event interruption, or conditions that existed before delivery, unless the law does not allow that limit.
Customers remain responsible for accurate site information, safe access, ground conditions, guest or worker conduct, and protection of units after placement. Kentucky Porta Potty Pros does not control a customer’s failure to follow the Kentucky Plumbing Code, OSHA 29 CFR 1926.51, or the 2010 ADA Standards for accessible routes and restroom clearances.
The customer must not cause an unauthorized sewage discharge. The EPA Clean Water Act and Kentucky Department for Environmental Protection wastewater disposal rules may create separate duties, penalties, or cleanup costs. Local zoning permits and event placement confirmation remain the customer’s responsibility unless a written agreement assigns that task to the company.
This section does not limit liability for conduct that Kentucky law does not permit a contract to exclude.
Questions, Notices, and Policy Updates
Please include the customer name, rental location, booking date, and a short description of the question or notice. A message is not a cancellation, schedule change, or dispute until the company confirms receipt through a reasonable written or recorded response.
Kentucky Porta Potty Pros may update these terms from time to time. The company may post the revised version on its website, send notice by email, include the update with a quote or invoice, or provide another written notice.
The revised terms apply to future bookings after their stated effective date. A change will not alter a separately signed agreement unless that agreement permits the change or both parties approve it in writing.
If a provision is found unenforceable, the remaining provisions will continue to apply as allowed by law.
